The Convention on Biological Diversity was completed in Nairobi in May 1992 and It was given countries to consider signing at the United Nations Conference on Environment and Development (UNCED) in Rio de Janero June 5, 1992. Currently, the Convention on Biological Diversity is the main international tool is used to solve the problems related to biodiversity to fulfill three main objectives:
It has 3 main objectives:
- The conservation of biological diversity
- The sustainable use of the components of biological diversity
- The fair and equitable sharing of the benefits arising out of the utilization of genetic resources
Biosafety is one of the issues, mentioned in the Convention. This concept refers to the need to protect human health and the environment from the possible negative impacts of the products of modern biotechnology. Concurrently, modern biotechnology is also recognized as having the potential development for human life. Especially, It is satisfies the basic needs on food, agriculture and health.
Pursuant to Article 19, paragraph 3, of the Convention on Biological Diversity, the Conference of the Parties, by its decision II/5, established an Open-ended Ad Hoc Working Group on Biosafety to develop a draft protocol on biosafety, specifically focusing on transboundary movement of any living modified organism resulting from modern biotechnology that may have adverse effect on the conservation and sustainable use of biological diversity.
Recognizing the importance of the Cartagena Protocol, the Government of Vietnam has ratified and became an official member of the Protocol on 19 Jan 2004. The Government assigns Ministry of Natural Resources and Environment (MONRE) is the national focal point for this Protocol in Vietnam.
As a member of the Cartagena Protocol on Biosafety, Vietnam needs to perform its obligations pursuant to the Protocol, including the provision of information to the portal on biosafety (BCH: Biosafety Clearing House) as defined in Article 20 of this Protocol.
The Government issued Decree No. 69/2010/ND-CP, on 21 June 2010, This Decree provides for biosafety for genetically modified organisms, genetic specimens and products of genetically modified organisms. In Article 46 of this Decree stipulates that Management of databases on genetically modified organisms: MONRE shall uniformly manage databases on genetically modified organisms and maintain a website on biosafety for genetically modified organisms. Line ministries that manage databases on genetically modified organisms in the domains under their management shall provide and exchange information and data on genetically modified organisms to and with MONRE. Provincial-level People’s Committees that manage databases on genetically modified organisms in their localities shall provide information and data to MONRE. MONRE shall guide in detail the exchange and provision of information specified in Clauses 1, 2 and 3 of this Article.
The Article 7 of Circular No. 09/2012/TT-BTNMT, on 22 August 2012 by MONRE to stipulate the provision and exchange of information and data on genetically modified organisms, Vietnam Enviroment Administration (VEA) are responsible for building and managing electronic portal on Biosafety; updated information and data on the electronic portal of biosafety in accordance with the law.
In order to share information on biosafety and fulfill the obligations and responsibilities on Protocol by the Government and MONRE assigned VEA establish The Portal of national biosafety (nBCH: National Biosafety Clearing House).
The main functions of nBCH:
As a reference tool of information on biosafety including legal documents, the risk assessment report, the capacity-building program, bilateral agreements and experts on biosafety, the daily updates on Biosafety.
The place to implement mechanisms to exchange information among the Ministries, The Sectors concerned in which the focal point to receive information that the Ministry of Natural Resources and Environment. Accordingly, the focal points of the ministries and Sectors concerned will submit information on biosafety related to owner management (Via username and password are granted) by Ministry of Natural Resources and Environment will synthesize to post news and respond to the International Portal.
